TERMS AND CONDITIONS OF USE
The following Terms of Use is a legal contract between an individual user and Fidelis PowerWash defining the rules and acceptable behavior of your website and services. Please update these guidelines according to your specific policies.
Welcome to the website of Fidelis Power Wash. By accessing our site, you agree to these Terms and Conditions of Use and are bound by all applicable laws and regulations.
The site and its original content, features, and services are owned by Fidelis Power Wash and are protected by international copyright, trademark, intellectual property, and other proprietary rights laws.
If, for any reason, we believe that our Terms and Conditions have not been upheld, we reserve the right to suspend or terminate access to our website without prior notice or liability.
Standard Terms and Conditions
1) Legally Binding Agreement:
By signing a contract with Fidelis Power Wash or accepting a service quote, you are signing a legally binding contract for work to be completed at an agreed-upon price. In the event that you break this contract, all deposits made to the company shall be surrendered as damages. If customer does not give notice within 24 hours prior to the time of service, a non-refundable charge of 100.00 will be charged to customer.
2) Product Warranties:
All warranties are limited to those offered by the manufacturers of the products used. Fidelis Power Wash makes no additional warranties. If you ever have a concern regarding our work, Fidelis Power Wash should be notified immediately.
3) Water Usage:
By signing this agreement, you agree to provide Fidelis Power Wash the right to use an on-site water
supply as needed to complete the stated project without compensation. If an exterior water supply is required, it will be at an additional charge. It is the customer’s responsibility to make sure the water supply is on and in working order before we arrive. Additional charges will be applied if water is not available.
4) Electrical Usage:
By signing this agreement, you agree to provide Fidelis Power Wash the right to use an on-site source of electricity as needed to complete the stated project without compensation. If an exterior source is required it will be at an additional charge. In 99.9% of cases, we will not utilize clients outlets.
5) Color and Tone Concerns:
The properties and species of wood age and weather can greatly affect the resulting color or tone of the stain. Note: Variances may occur on individual boards as well as the total project, as densities and other characteristics vary across and throughout the wood. Fidelis Power Wash and its associates attempt to represent the final finish color and tones as best as possible. While we can often give you an idea of the overall color or tone you must expect some variance in the overall finish.
6) Courtesy:
While Fidelis Power Wash is on location and performing work on your property, you are responsible for keeping all children and pets, as well as other individuals away from the work area. Children and
pets must be kept off the work surface for at least 24 hours after our work is completed. This is for your
safety as well as our own.
7) Payments:
Payments to Fidelis Power Wash are due as per the contract schedule and are to be paid by check, cash, or other agreed upon payment. All balances are always due upon completion of the job. Any variance to this policy must be agreed upon and in writing on our contract. Late charges will be immediately assessed on all balances not paid in accordance with contract terms. The customer agrees to pay any collection cost incurred by Fidelis Power Wash related to the collection process of outstanding balances. Any invoice or scheduled payment over 10 days past due will be subject to a 2nd automated request for payment. Any invoice past 20 days overdue, you will receive a phone call to discuss payment options from the owner, or representative of Fidelis Power Wash. If any invoice or scheduled payment goes 30 days past due, Company shall have the right to file a civil suit to collect the outstanding debt. Company further reserves the right to refuse to continue to do business with a client who is currently past due.
8) Scheduling:
Scheduling in a business which productivity relies upon the weather can be difficult. Inclement weather may affect scheduling. We try our best to keep scheduling conflicts to a minimum, however, circumstances that are beyond our control may affect your project start and completion dates. You will be notified of any changes.
9) Removal & Replacement of Deck Contents:
Removal and replacement of grills, deck furniture, planters, and any other items are the responsibility of the homeowner. All items should be moved at least 15 feet away from the cleaning surface. Should we need to remove items from the deck, we will not be responsible for any damage, breakage or for storage issues. An additional charge will be applied for the time and labor devoted to the removal of these items at our current standard rate at time of service job. Client is responsible tor moving items back to original location if Fidelis Power Wash needs to move items away from the cleaning surface.
10) Damages:
Fidelis Power Wash is not responsible for damages due to improperly installed siding, loose shingles or siding, broken or opened windows, improperly sealed windows and doors, wood rot, defective construction, improperly secured wires, loose or improperly installed gutters, oxidized surfaces, and leaders and improper caulking. In every aluminum siding case and in some cases with vinyl siding, the sun and weather will bleach the color or cause fading, otherwise known as oxidation. Power washing, which entails the removal of chalky, gritty, or failing surface materials may cause the faded aspects of the vinyl or aluminum to stand out. Fidelis Power Wash will not be responsible for such conditions, but we may have a solution to take care of this for you with a different cleaning package. Fidelis Power Wash will not be responsible for loose mortar that may dislodge during the cleaning process.
On the date of the cleaning service, Fidelis Power Wash will note any pre-existing damage to the area to be serviced using a checklist sheet that will be signed by Client. In cases when Client cannot sign, Company will note the absence and take photos of the noted damages, and send correspondence to client. Client or the homeowner should also sign the checklist sheet as proof that they have been informed of any damage. If Company found any new damage, the services will stop until Client can see the damage and acknowledge its existence unless previous agreement with client exists.
11) Stains:
Some stains cannot be removed by power washing. Tree sap, artillery fungus, splatters from stains and paints are examples of materials that cannot be removed by conventional means. We make every attempt to point these areas out to the customer when quoting the project, and notes will be included during the pre-inspection and delivered to the customer. Sometimes these stains
cannot be removed at all.
12) Watertight:
Fidelis Power Wash Services expects your property to be in good repair and weathertight. This
includes, but is not limited to all electrical services including receptacles and light fixtures. Doors and windows shall also be weathertight. Fidelis Power Wash Services is not responsible for damages as a result of water infiltration from poor or improper installation, maintenance, or repair of electrical-related items or doors or windows. Fidelis Power Wash cannot guarantee removal of artillery fungus from exterior house surfaces.
13) Window Spotting:
Windows may become water spotted as a result of our services. Window cleaning is NOT included. An additional upcharge may be available to purchase if party receiving services from Fidelis Power Wash chooses this additional service. Fidelis Power Wash recommends to the customer to remove all window screens prior to the service job to ensure a more thorough cleaning service.
14) Concrete:
The appearance of concrete depends on a number of factors most linked to when the concrete was initially poured and cured. Fidelis Power Wash may not recommend high pressure cleaning is the concrete is not sufficiently cured. When concrete with dirt, mold, mildew, algae and other pollutants and stains are cleaned, the concrete will then reveal any and all imperfections that the pollutants and stains have covered up. The customer understands that not all concrete will look the same even on the same driveway, patio, sidewalk, or concrete slab.
15) Unseen estimates:
Fidelis Power Wash may provide an "unseen estimate" for service utilizing high resolution satellite imagery or SRTM data to accurately measure both distance and areas of the requested service. Forms can be filled out by customer noting trouble areas, however not all requested cleaning surfaces can be adequately quoted without a qualified technician on site. Price of online quote is subject to change based on new findings during on site pre-inspection, and correspondence will be delivered to Client prior to Fidelis Starting services.
16) Customer understands that Fidelis Power Wash uses a cleaning solution that is tailored to each job. When implemented properly, this solution will not cause any damages during a house wash, or our cleaning services. Client should not be alarmed if there is a rusty color on Client’s siding. These are called weep holes to allow ventilation and allow condensation to drain out. Any remaining streaks from these can be washed off with rain, or a regular garden hose.
17) Roof Treatment Acknowledgment.
Customer understands that Fidelis Power Wash uses a cleaning solution that is guaranteed to kill damaging growths like algae, moss, or lichen. Roofs react differently to the solution, meaning the result may vary. There are times when it takes more time to completely remove the dead growths. Fidelis Power Wash will not leave the solution on your roof, and we will ensure that each roof wash is adequately rinsed. Some companies may tell you that your roof will look better after it receives normal rain showers and that there is no need to rinse, however we want to ensure that you are satisfied with our service at the time it is completed.
18) Customer understands that Fidelis Power Wash should be notified in advance in email or in writing if there are particular surfaces in the area or its surrounding that are sensitive to Company’s cleaning solution (Sodium Hypochlorite). If not, Company is not responsible for any ill-effect that it may cause on any surface. Company is not responsible for any ill effects to any substrates that were not pre-discussed beforehand with an email in our inbox. If Company has not been notified in advance in writing that something cannot have detergent upon it, Company is not responsible for it. Fidelis Power Wash will take every precaution including pre wetting sensitive bushes, areas, as well as continuous watering via an ongoing sprinkler during the time of service to ensure dilution of our cleaning solution. Sometimes customers plants and bushes may be temporarily discolored due to our chemical mixture, and most of the time these plants will return to normal coloration after a few days. If there are any plants that do not return and are permanently damaged, please contact our office, and we will ensure that we review the pre-inspection walkthrough and Fidelis Power Wash will take responsibility of replacing damaged plants.
19) Please note that it will be unlikely for us to provide full services to any Client with high value fish ponds, but we will be able to provide an eco friendly option in some specific cases.
